Terms & Conditions
The acceptance of this catalogue includes the acceptance of the following terms and conditions. In the event of your official order forms containing special printed conditions, it is understood that such conditions are only binding in so far as they are not at variance with the terms and conditions contained herein.
- No variation to these terms and conditions of sale is permitted unless such variation has been authorised in writing by a Flowtech director.
- Reference herein to goods shall include all goods and services sold to you.
DRAWINGS AND SPECIFICATION
All drawings and specifications, dimensions and weights provided by us are approximate unless otherwise stated. Therefore, we accept no liability for damage or injury arising from any error or omission in the data provided. Images are for illustration purposes only.
Any performance details given are based upon our experience and are such as we expect to obtain on test. We accept no liability for any failure to achieve stated performance figures unless the performance data has been confirmed in writing by a Flowtech director. You assume responsibility for the capacity and performance of the goods being sufficient and suitable for your purpose.
Any times quoted for despatch are from the receipt by Flowtech of an order to proceed. Elapsed times of despatch are submitted without liability for delay however occasioned, but every effort will be made to achieve them. If you arrange to collect goods yourself it is your responsibility to collect these goods within 3 working days. If you do not, we reserve the right to send these goods by our carrier and you will be charged for that service
OUT OF HOURS SERVICE
Orders requiring delivery or collection during the following times are classed as ‘Out of Hours’: Monday to Thursday 10pm to 8am, Friday 10pm to Monday 8am, bank holidays and official closure days. Orders requiring delivery or collection during these times must be placed using the Out of Hours service and the associated call out and delivery charges will apply.
For your protection and for our training purposes, your call may be monitored and recorded.
DAMAGE/LOSS IN TRANSIT/NON-DELIVERY/LATE DELIVERY
It is your responsibility to inspect the goods promptly on arrival. Any claims for damage, non-delivery, loss in transit or late delivery must be made within 4 days of the delivery date. When signing for your consignment, it is your responsibility to check that the number of parcels being delivered corresponds with the number of parcels stated on the consignment note. If not, the note should be amended accordingly before signature. If the consignment is being delivered later than specified, it is your responsibility to write the time of receipt on the consignment note. If there is any apparent damage to the parcel, it is your responsibility to annotate the consignment note accordingly.
Should any defects develop under proper use of the goods supplied within a period of 12 months after delivery as a consequence of design, materials or workmanship then we will make good by repair or replacement any such defect providing the defective goods are returned to us promptly at the following address:

All goods must be adequately packaged. Carriage will be organised by Flowtech at our cost. Under no circumstances should goods to be returned under guarantee be given to a local Flowtech representative. We shall not be liable in any way for consequential damage or loss or injury. All goods will be inspected upon return. Photographs may be required for faulty/damaged items. We reserve the right to return goods to the supplier for repair.
KELM 2 YEAR WARRANTY
Should any defects develop as a consequence of faulty design, workmanship or material, within the warranty period of 2 years after delivery of the product or before achieving the recommended maximum life usage whichever is the earlier, we will make good by repair or replacement any such defect providing the defective goods are:
- reported to the seller with notification of the defect within the warranty period;
- returned to the seller for full inspection without any further use of, or alteration to, or interference to the product;
- the defect is a result of the product being misused and not installed as per the operator's manual.
You are specifically required to examine the goods and any query relating to the delivery must be notified within 4 days of receipt. We shall have the option of replacing or crediting the value of goods in respect of which we accept a complaint and thereby terminate our liability. We cannot be held responsible for charges incurred by you in attempting to rectify or modify goods without our written agreement. Any pricing or carriage queries must be reported within 4 days of the date of invoice. No credits will be raised outside of this time period.
RETURNS AND HANDLING CHARGES
Requests by you to return catalogue goods to us will be accepted subject to a handling charge if all of the following criteria are met:
- the goods are unused and are sourced from the Flowtech catalogue;
- the goods are in a resalable condition;
- the goods were invoiced within 10 days of the date of return;
- carriage is organised by us – goods must be ready for collection within two days after a returns number is issued. We will only attempt to collect the goods once, goods must be made available for this collection;
- the return must include a Flowtech Returns Number. Goods returned without a returns number will be transferred to our Customer Collection Point and you will be notified to collect the goods within 7 days.
- Items returned must be in their original packaging where possible, all instruction manuals and accessories must also be included;
- single line returns of less than £10 will not be processed;
- any goods shipped outside of the UK must be returned to a valid UK address at your cost for us to arrange collection.
Handling charges will be levied as follows: goods invoiced within 30 days of the date of return will be subject to a £10 return fee on all orders. Alternatively you can return goods via your own method and not incur a handling charge. All Goods must have a valid returns number as confirmed by Flowtech Customer services and clearly marked on the box. All goods must be adequately packed and addressed to:
Flowtech, Distribution Centre Returns Department, Pimbo Road, Skelmersdale, Lancashire, WN8 9RB.
For the avoidance of doubt, returned goods will only be accepted if the above requirements are met. Flowtech cannot accept responsibility for returns forwarded by customers using their own carriers. Under no circumstances should goods to be returned be given to a local Flowtech representative. Flowtech is unable to accept any return of goods sourced on a customer’s behalf which are not listed within the Flowtech catalogue. Such orders for non-catalogue goods are non-cancellable and non-returnable and as such are accepted entirely at the customer’s own risk.
If you wish to cancel an item on back order, you must request a Cancellation Number from the operator. Credits will not be processed without reference to a specific Cancellation Number. For the avoidance of doubt, items not listed in the Catalogue are non-cancellable and non-returnable. Once an order for direct shipment from supplier is in process, we are unable to either amend or cancel the request.
The contract shall in all respects be construed and operated as an English contract and in conformity with English Law.
All price lists, quotations and estimates are subject to alteration without notice, and goods will be invoiced at prices ruling on date of despatch regardless of any price quoted on any purchase order submitted. Carriage and packing will be charged in accordance with the specification of service shown in this catalogue. Prices and charges are listed exclusive of Value Added Tax, which will be added in line with prevailing legislation. All Web/App orders will be viewed as acceptance to the prices shown on screen and pricing credits will be refused.
Special Contract Prices
When special contract prices are agreed, we reserve the right to add 5% per month to the invoice price of any batch which is held on your instructions, or if payment is not made within the agreed period shown on the quotation.
All goods supplied by us to you remain the property of Flowtech until the goods have been paid in full. As a result of our continued commitment to provide goods of the highest quality at the most competitive prices, it may be necessary on occasions to supply goods that will differ from those depicted in this catalogue.
CALL OFF STOCK & SCHEDULED ORDERS
Call Off Stock Agreements and Scheduled are effective for the time period as agreed between Flowtech and the customer.
- General Scope
This Agreement between Flowtech and the customer is to enable the customer to access an agreed list of products on a Call Off basis.
- Risk and Title
The Risk (liability for the goods) in the product shall pass to The Customer as the products are ordered by Flowtech /reserved at Flowtech’s site. The Title to the product shall pass from Flowtech to The Customer when the product is issued from the Stock and is billed to The Customer. The Customer is responsible for the property of Flowtech until title passes and will under-write the cost of such Product accordingly. All products supplied specifically against Call-Off and Scheduled Agreements will be non-cancellable, non-returnable and non-refundable.
- Stock Levels
The Supplier will ensure that the agreed Call Off stock levels for all products are satisfied at the outset.

Carriage and packing will be charged in accordance with the specification of service shown in this catalogue. Payment will be based on the standard terms as agreed by The Customer.
This Agreement will terminate on fulfilment of the Call-Off Stock order or 6 months after the goods being available for despatch, whichever is sooner. Any items not called off by The Customer after 6 months of the goods being available for despatch, will be shipped.
In the case of default, you agree to allow us or our agent to enter your premises where the goods are kept and remove same. You will be responsible to us for all costs incurred in reclaiming the goods.
Payment terms are strictly 30 days nett. If any sum is not paid on the due date for payment, all sums then outstanding from you will immediately become due and payable notwithstanding that such sums would not otherwise be due until a later date. To comply with the 2003 Money Laundering Regulations, we are unable to accept cash payments of the equivalent of £15,000 for any single transaction. The terms relate to Mainland UK addresses only. Charges for more remote locations, e.g. Scottish Highlands and Islands, Channel Islands, etc. are available on request. Flowtech reserves the right to provide 2/3 day service for palletised orders and/or orders over 30kg in weight. Premium delivery services are available on request. Next Day deliveries will be made up until 6pm. Orders taken on Fridays will be delivered on Monday. It may not be possible to provide a same day service on some products. Certain products in large quantities may attract a higher carriage charge.

Pallet Charges: Will be advised and discussed prior to shipping. This will be dependent on product weight/dimensions and every effort will be made to keep costs to a minimum whilst maintaining the service.
You may find it more convenient or indeed more cost effective to send in your own courier to collect on a EXW basis. Please ensure this is clearly stated when you place your order.
